Terms of service

1. About These Terms

1.1 These Terms and Conditions apply to all goods sold by TruckSpares365 (“we”, “us” or “our”) to you, the customer (“you”), through our website at www.truckspares365.co.uk or by telephone.

1.2 Every order you place with us is made on the basis of these Terms and Conditions and is subject to our acceptance. We accept your order when the goods are delivered to you, and a legally binding contract between you and us is formed at that point.

1.3 Processing your payment and acknowledging your order does not amount to legal acceptance of your order. This includes any email confirming that your order is being processed.

2. Ordering

2.1 To buy a product on our website, follow the onscreen instructions. You can review your order and correct any input errors until you place it by clicking “Confirm Order”.

2.2 All orders are subject to our acceptance, as set out in clause 1.2. We may decline any order for any reason, and in that case we will not be liable to you or to anyone else.

2.3 Once we accept your order, we are legally obliged to supply goods that conform with these Terms and Conditions.

2.4 We, our employees or our agents may give you advice or recommendations about the storage, application or use of the goods. If that advice has not been confirmed in writing by our authorised representative, you follow or act on it entirely at your own risk. We will not be liable for any advice or recommendation that has not been confirmed in this way.

3. Prices

3.1 All prices quoted online are shown excluding UK VAT, unless stated otherwise. The price you pay is the price shown when you submit your order.

3.2 We make every effort to keep our prices up to date, but we reserve the right to change prices at any time without notice.

3.3 From time to time we advertise goods at a promotional price. You must enter the relevant promotion code, or you may be charged the full price.

3.4 Occasionally, goods may be priced or described incorrectly, either in error or because of external circumstances. If this happens, we are not obliged to supply the goods at the incorrect price, in line with the incorrect description, or at all. We reserve the right to correct errors at any time. At our discretion, we will either:

  • cancel your order and refund the price you paid; or
  • make reasonable efforts to contact you and ask whether you wish to proceed at the correct price or with the correct description.

If we cannot reach you, or you do not wish to proceed on that basis, we will cancel your order and refund the price you paid.

4. Payment

4.1 We accept payment by all major credit and debit cards and PayPal. We also offer pay later and split payment options through Klarna.

4.2 We must receive payment in full for your order, including any applicable delivery charges, before we can process it.

4.3 Most online card payments are processed securely through Stripe, one of the world’s largest payment gateways. All card information is collected by Stripe, and TruckSpares365 does not collect or have access to your card details.

4.4 When you pay by credit or debit card, you confirm that the card belongs to you or that you are authorised to use it. When you pay by PayPal, you confirm that the PayPal account belongs to you.

4.5 All payments are subject to validation checks and authorisation by the card issuer, PayPal or Klarna, as applicable. If payment is not authorised:

  • we will not accept your order;
  • we are not obliged to tell you why the payment was refused; and
  • we will not be liable for the item not being delivered to you.

We are not responsible for any charges your card issuer, bank, PayPal or Klarna makes to you in connection with your payment.

4.6 We reserve the right to refuse payment details if we believe they are being used fraudulently.

4.7 We recommend that you never send your payment card details, or your PayPal details and password, to anyone by email, including us. Subject to clause 11.3, we cannot accept responsibility for any losses you incur when sending information to us over the internet or by email.

5. Delivery

5.1 All orders are shipped from the UK. Full details of our delivery options, charges, cut-off times and timeframes are set out on our Delivery Information page.

5.2 We aim to deliver your order within the stated delivery time, and no later than 30 days after the day you place your order, unless we agree otherwise with you. This is subject to clauses 7 and 14. We reserve the right to deliver an order in instalments, using separate shipments.

5.3 Before placing your order, please check our delivery options to make sure we can deliver to your address. A valid signature may be needed on delivery. If you have not received all of the goods within the stated delivery time, please contact us immediately at office@truckspares365.com. In the unlikely event of a delay, we will contact you with an update.

5.4 We strongly recommend that you do not plan or start any installation work until you have received your order and checked that all the goods are suitable for your purposes and are free from defects and missing parts.

5.5 For health and safety reasons, and to prevent damage to property, items can only be delivered to the outside of a ground-floor location at the delivery address. If an item needs to be moved from the delivery location, you must make your own arrangements at your own risk. We do not provide unpacking, installation, fitting or waste removal services on delivery unless we have agreed to do so in writing.

5.6 You must take all reasonable steps to allow delivery to take place at the agreed time and place. If you delay delivery, or delivery fails because you have not taken appropriate steps, we will try to arrange another delivery time or date within 30 days of the failed delivery. If delivery fails due to circumstances within your reasonable control, you must pay the cost of any re-delivery. If we cannot arrange a re-delivery date, we may cancel your order and refund the price you paid for the goods.

6. Ownership and Risk

6.1 The goods are at your risk and become your responsibility once they are delivered to you. Ownership of the goods will not pass to you until we have received payment in full.

7. Availability

7.1 All goods are subject to availability. If we do not have enough stock to supply goods you have ordered and paid for, we will try to contact you using the details you gave us to ask how you would like to proceed. At our discretion, we may process any part of the order that is available. Where goods are out of stock, we will refund the price you paid for them as soon as possible and in any event within 14 days.

8. Cancellation, Returns and Refunds

Cancellation

8.1 If you wish to cancel your order, please let us know within 14 days of receiving your goods by contacting us using the details in clause 18. Please quote your order number when you get in touch.

8.2 Once your cancellation has been confirmed, we will refund you using the same payment method you used for your order.

Returns, Refunds and Faulty or Incorrect Goods

8.3 For full details on returning items, refunds, and faulty or incorrect goods, please see our Returns and Refunds Policy.

Your Legal Rights as a Consumer

8.4 Nothing in this clause 8 affects your legal rights if you are a consumer.

9. Manufacturer’s Warranties

9.1 Some of our goods come with a manufacturer’s warranty, guarantee or similar assurance; please check the relevant product description. Any complaint, query or claim under such a warranty must be made directly to the manufacturer, unless our Returns and Refunds Policy states otherwise. We have no responsibility or liability under or in connection with it.

9.2 Some products come with an extended manufacturer’s warranty, which must be registered within 28 days of purchase. Please see the product documentation for further details.

9.3 We will have no liability under any warranty, condition or guarantee if the full price of the goods has not been paid.

10. Images and Product Information

10.1 We make every effort to ensure that our product images are accurate and up to date. However, all images are for illustration only. Contents or accessories shown in images are not included unless the product description states otherwise.

10.2 All product images are either owned by TruckSpares365 or used with the permission of the originator, and they remain the copyright of the originator. We take any unauthorised use of images owned by TruckSpares365 very seriously.

10.3 We make every effort to ensure that our product information is accurate and up to date. All product descriptions are used with the permission of the originator and remain the copyright of the originator.

10.4 Original equipment (OE) part numbers are used for identification purposes only. They do not imply or indicate the identity of the manufacturer.

11. Liability

11.1 If you buy goods from us as a consumer, meaning anyone acting outside the course of their business, trade or profession, then, to the extent the law permits, we accept no liability for any:

  • loss that is not foreseeable (a loss is foreseeable if it was an obvious consequence of our breach, or if both you and we contemplated it when our contract was formed);
  • loss arising when we are not at fault or in breach of these Terms and Conditions; or
  • business loss, including loss of profits, business, contracts, goodwill or business opportunity and other similar losses, as well as business interruption.

11.2 If you buy goods from us as a business or trade customer, we will have no liability to compensate you, whether in contract, tort (including negligence), breach of statutory duty or otherwise. The only exception is any refund we make under these Terms and Conditions or otherwise at our discretion.

11.3 Nothing in these Terms and Conditions is intended to affect your legal rights as a consumer. Nor is anything intended to exclude or limit our liability to you for:

  • fraud or fraudulent misrepresentation;
  • death or personal injury caused by our negligence; or
  • any other liability that cannot be limited or excluded under applicable law.

11.4 Goods are intended for use in the UK only, and we cannot confirm that they comply with any laws, regulations or other standards that apply outside the UK. All goods are sold in line with the manufacturer’s specifications and are subject to any qualifications, representations or instructions in the documentation supplied with them.

12. Age-Restricted Goods

12.1 When you order age-restricted goods, such as solvents, axes, knives and knife blades, you confirm that you are aged over 18. Where relevant, you also confirm that delivery will be accepted by someone aged over 18. We reserve the right to cancel your order if we reasonably believe you do not meet the age restrictions for certain goods.

13. Termination

13.1 We may suspend supply or delivery, stop any goods in transit, or end our contract by giving you written notice if you breach any obligation under these Terms and Conditions. If this happens, we will have no further obligation to supply goods to you.

14. Events Outside Our Control

14.1 We will not be liable to you where any of the following is caused by an event or circumstance beyond our reasonable control:

  • any failure or delay in supply or delivery;
  • any damage to or defect in goods supplied or delivered; or
  • any other liability.

Such events include, without limitation:

  • accidents, fire, explosion and mechanical failure;
  • extreme weather, flood, storm, earthquake, natural disaster and acts of God;
  • failure of telecommunications networks and inability to use transport networks;
  • terrorist attack, war, civil commotion and riots;
  • strikes, lockouts and other industrial disputes;
  • acts or restraints of government, and the imposition of, or restrictions on, imports or exports.

15. Disposal of Electrical and Electronic Equipment

15.1 The WEEE Regulations (January 2013) aim to reduce the amount of waste from certain electrical and electronic equipment. They ensure that this waste is kept separate from household waste, collected separately and ultimately disposed of in an environmentally sound way (recycled and recovered).

If you are a business or trade customer, you agree that you are responsible for the collection, recovery or treatment, and disposal of any non-household electrical or electronic equipment you buy from us.

For household waste, please take it to your nearest Designated Collection Facility (DCF). To find your nearest DCF, please visit www.recycle-more.co.uk.

16. Complaints

16.1 We take the satisfaction of our customers very seriously. If you feel you have received substandard information or service from us, we would like to hear about it so that we can stop the same thing happening again. We will make every effort to put genuine problems right as quickly as possible. Complaints can be made by emailing office@truckspares365.com.

17. General

17.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, this will not affect the validity, legality or enforceability of the remaining provisions, or of the rest of the provision concerned. Our contract is governed by and will be interpreted in accordance with English law.

17.2 Every “Was” price displayed is the higher price previously charged for that item.
